Child Support

Mississippi has strict guidelines for establishing child support. The judge has very little discretion to order child support payments which differentiate from the child support guidelines. In Mississippi, child support is established based upon a specific percentage of the non-custodial parent's income.

Visitation

In most circumstances, when one parent is awarded sole custody, it is still in the child's best interest to maintain a meaningful relationship with the other parent. In these instances, the non-custodial parent is awarded visitation rights. The parents may establish an agreement regarding a visitation/parenting time schedule. However, if there is not an agreement, typically visitation will be set for every other weekend, every other holiday and additional time in the summer.

Modification of Custody, Visitation or Support

In order for a court to order a modification, there must have been a substantial change in circumstances, the change in circumstances must have had an adverse impact on the child's interest and the proposed modification must be in the child's best interest.
